1. ACCEPTANCE OF THESE TERMS
By accessing or using any website, mobile site, application, email program, SMS program, consultation, or other online service that links to these Terms (collectively, the “Services”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Services.
2. ELIGIBILITY & GEOGRAPHIC RESTRICTIONS
The Services are intended for natural persons 18 years or older residing in the United States. We do not knowingly offer or market the Services outside the U.S. or to children under 13.
3. CHANGES TO TERMS
We may update these Terms at any time. Material changes will be posted with a new “Effective date.” Continued use after a change means you accept the revised Terms.
4. ACCOUNT REGISTRATION
Certain features require creating an account or providing contact details. You agree to provide accurate information, keep it current, maintain the confidentiality of credentials, and accept responsibility for all activities that occur under your account.
5. DESCRIPTION OF SERVICES
CareFamily provides a family‑led home‑care matching platform that helps households locate, vet, and contract with private caregivers. We are not a licensed home‑care agency, nursing agency, or law firm. We do not employ caregivers and we do not provide medical, legal, tax, or financial advice.
6. LICENSE & INTELLECTUAL PROPERTY
All text, graphics, logos, software, and other content are owned by CareFamily or its licensors and are protected by U.S. copyright, trademark, and other laws. Subject to your compliance, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Services for personal, non‑commercial purposes.
7. USER CONTENT
If you submit reviews, comments, videos, documents, or other materials (“User Content”), you grant CareFamily a worldwide, royalty‑free, perpetual license to host, store, reproduce, adapt, publish, and display that User Content in connection with operating and improving the Services. You represent that you own or control all rights to the User Content and that it does not infringe any third‑party rights.
8. PROHIBITED CONDUCT
You agree not to:
Violate any applicable law or regulation
Post unlawful, defamatory, or obscene content
Upload viruses or malicious code
Attempt to reverse‑engineer, scrape, or hack the Services
Use automated means (bots, crawlers) without our prior written consent
Impersonate any person or entity or misrepresent your affiliation
9. FEES & PAYMENT
Some offerings may carry fees described on the applicable order page or engagement letter. All payments are due as stated; late payments may incur interest or suspension of Service.
10. THIRD‑PARTY LINKS & PARTNERS
The Services may contain links to third‑party websites or may refer you to attorneys, payroll vendors, or other professionals. We do not control and are not responsible for third‑party content or services. Your dealings with third parties are solely between you and them.
11. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. 12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREFAMILY, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. 13. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless CareFamily and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) your User Content, or (c) your breach of these Terms.
14. TERMINATION
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
15. GOVERNING LAW
These Terms and any dispute will be governed by and construed in accordance with the laws of the State of California, without regard to conflict‑of‑law provisions. California Post
16. DISPUTE RESOLUTION & ARBITRATION
Binding Arbitration: Any claim or dispute arising under these Terms that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association in Los Angeles County, California. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Class Action Waiver: You and CareFamily agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
17. SEVERABILITY & WAIVER
If any provision is held unenforceable, the remaining provisions will remain in full force and effect. No waiver by CareFamily of any breach shall be deemed a further or continuing waiver of any other breach.
18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any supplemental terms expressly agreed in writing, constitute the entire agreement between you and CareFamily regarding the Services and supersede all prior agreements or understandings.
